Judge Sue L. Robinson: Inequitable Conduct Claim “Passes Muster” Under Exergen

In yet another decision addressing the sufficiency of pleading inequitable conduct, the Court found under the new standard set forth in the Exergen case that defendant Cisco’s amended claims “pass muster under this rigorous standard” and granted defendant’s motion for leave to amend.
